Koninklijke Philips N.V. and its subsidiaries ("Philips") believe strongly in protecting the privacy of the personal information you share with us. We also believe it is important to inform you about how we will use your personal information, and to give you choices about how those data will be used. Therefore, we encourage you to read this Privacy Notice carefully, before you make your choices and give us the right to use your information. This is a notice of our privacy practices, not a contract or an agreement.
 

This Privacy Notice applies to all personal information of consumers collected via the use of the uGrow Smart Baby Monitor by Philips Avent (“Monitor”) the uGrow Smart Baby Monitor by Philips Avent mobile application (“App”) and the usage of a My Philips account that are controlled by or under the control of Koninklijke Philips Electronics N.V. or any of its subsidiaries (”Philips”).


Type of Information We Collect and How We Use It
 

The App, in combination with the Monitor, collects or uses personally identifiable information ("personal information") in connection with your downloading or use of the App and use of the Monitor. Philips collects your personal information for the following purpose:

(1) For providing the Video & Audio service.

What does this purpose entail?

When you use the Monitor, we process personal information to deliver the functionalities of the Monitor. We will use your video & audio so we can display, via your own mobile device, the video and sounds captured through the Monitor. When you use the App, the App will provide you with live stream video & audio. The Monitor also measures room temperature and humidity, which will be available to you when you use the App.
 

Baby Monitor owners who have installed the App will also have the possibility to give secure access to the video & audio stream to family members or friends (“Delegates”). Delegates that install the App and create a login, will be able to receive the video & audio captured by the Monitor via the App and use the App to communicate with the owner.

Which personal information do we process for this purpose?

  • Audio and video feed: the Baby Monitor captures video and audio and streams it to the App for live viewing.
  • Room temperature: the Monitor records the room temperature. The App is designed to send you notifications when the temperature is out of range, as set by the user.
  • Room humidity: the Monitor records the room humidity. The App is designed to send you notifications when the humidity is out of range, as set by the user.


Of which parties do we make use for this purpose?

We make use of the service of a trusted third party for transmitting of the video and audio stream data.

We will only use your data for this purpose if you have provided us with prior consent. If you do not consent to the processing of your video & audio, you will not be able to use the App.

Service accessing sensors or features on the phone, such as:

  • Camera
  • Accessing photos
  • Sharing in social media
  • Access to microphone


We will only use your data for this purpose if you have provided us with prior consent.

(2) For generating statistical data to help us improve the content, functionality and usability of the App.

What does this purpose entail?

We collect and analyze usage statistics to help us improve the content, functionality and usability of the App.
 

Which personal information do we process for this purpose?

For this purpose, we process session and usage data as well as log data. Session and usage data is information about your use of the App, including your unique User Device number, the IP address of your device, the type of mobile internet browser or operating system you use, and the dates and times of your use of the App.
 

Of which parties do we make use for this purpose?

We make use of the service of a third party to analyze statistics data.

(3) For managing your account.

What does this purpose entail?

We will use your registration information to create and manage your App account. When you create an account, we will send you a welcoming email to verify your email address, to respond to your inquiries, and to send you strictly service-related announcements, for instance, temporarily suspension alerts related to maintenance. 

Which personal information do we process for this purpose?

  • User Profile: We will use your username, name, photo, email address, country, language, password, gender, relation to the baby
  • Baby Profile: due/birth date
     

Do we make use of third parties for this purpose?

We make use of the service of a third party to register and retain our registration records, including the personal information you provide.

(4) For sending you information about Philips and Philips products and services via the App or by e-mail.

What does this purpose entail?

We would like to use your email to keep you updated on our latest products and services and other opportunities and developments within Philips.
 

We will only use your data for this purpose if you have provided us with prior consent.
 

Which personal information do we process for this purpose?

For this purpose we process your name, your e-mail address, your User Unique ID, your date of birth, your gender, and an overview of which e-newsletters we have sent you.

How We Share Information with others
 

Philips makes use third-party vendors or hosting partners who act on behalf of Philips, in order to provide the necessary hardware, software, networking, storage, transactional services and/or related technology required to run the App or the services provided.
 

Philips also uses the services of third-party services providers to help provide and understand the use of our App. These third-party service providers collect data sent by your mobile device, such as session, usage and log data.
 

Our agreements with these third parties will limit the purposes for which your personal information can be used and disclosed, and will require your personal information to be adequately safeguarded.
 

Philips will disclose personal information only under this notice and/or when required by law.
 

Philips sometimes sells a business or a part of a business to another company. Such a transfer of ownership could include the transfer of your personal information directly related to that business, to the purchasing company.
 

Cloud
 

Philips stores your personal information in a cloud. This means that your personal information is processed on behalf of Philips by a cloud service provider and can be stored in different locations around the world. Philips makes use of organizational and contractual measures to protect your personal information and to impose requirements on our cloud services providers to restrict the use of your personal information exclusively for the purposes mentioned above.

Your choices and rights
 

We want to know you better so we can serve you better while at the same time, we respect your choices about how we use your personal information. Your personal information may be transferred from your home country to other Philips companies, in different locations around the world. You may at any time opt-out of our marketing services via the unsubscribe link in each email sent to you by Philips. Additionally, you may at any time request access to your personal information, request correction or erasure of your personal information, and object to any processing of your personal information via your App account or by emailing us at privacy@philips.com.

We will respond to your access and/or correction request within 4 weeks.

Security of Your Information

We recognize and take seriously our responsibility to protect the personal information you entrust to Philips from loss, misuse or unauthorized access. Philips uses a variety of security technologies and organizational procedures to help protect your personal information. For example, we implement access controls, use firewalls; secure servers and we encrypt certain types of data, such as sensitive data.


Special information for parents
 

While Philips Apps are not generally targeted at children under the age of 14, it is Philips policy to comply with the law when it requires parent or guardian permission before collecting, using or disclosing information of children.


Philips strongly recommends that parents take an active role in supervising the online activities of their children, especially when making purchases through our Apps.

Local specific information: Your California Privacy Rights
 

California Civil Code Section 1798.83 permits our customers who are California residents to request and obtain from us once a year, free of charge, information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. Changes to this Privacy Notice
 

The services that Philips provides are always evolving and the form and nature of the services that Philips provides may change from time to time without prior notice to you. For this reason, we reserve the right to change or add to this Privacy Notice from time to time. We encourage you to check back often to review the latest version.


The new Privacy Notice will be effective upon posting, if you do not agree to the revised notice, you should alter your preferences, or consider stop using the App. By continuing to access or make us of our services after those changes become effective, you agree to be bound by the revised Privacy Policy.
