- Respironics’ product samples are provided so that patients and/or their healthcare professionals can become familiar with the products and develop an understanding of the use and value of Respironics’ products with particular patients;
- Product samples are not provided to solicit or encourage any healthcare provider to purchase, prescribe, use or recommend Respironics products or to reward any such prior action;
- Samples are not provided as a gift or charitable contribution, and may not be sold, purchased, traded or offered for sale, purchase or trade;
- Company shall not bill any state, federal or private healthcare programs on behalf of the patients for the sample product;
- Respironics and Company certify that they will comply with the Anti-Kickback Statute, set forth at 42 U.S.C. § 1320a-7b(b) (“Anti-Kickback Statute”) and related federal or state health care program requirements.
